Hereinafter referred to as “Plunged”.
1.2. Plunged offers, among other things, sauna, cold plunge and recovery/wellness services, as well as single sessions, credit packs, memberships, gift cards, events and related services.
For the purposes of these general terms and conditions, the following definitions apply:
3.1. These general terms and conditions apply to all offers, purchases, bookings, memberships and services of Plunged.
3.2. By making a purchase or booking or taking out a membership, the customer confirms that they have been able to consult these general terms and conditions and accepts them.
3.3. The House Rules form an integral part of these general terms and conditions. Every participant must comply with them.
3.4. When someone makes a booking for another participant, the person making the booking is responsible for correctly passing on the applicable terms and House Rules to that participant.
3.5. Specific conditions expressly communicated for a promotion, event, private booking or other special offer shall, insofar as they deviate from these general terms and conditions, take precedence for that specific offer.
4.1. Participation in a session in principle requires a prior booking via the website or app.
4.2. A booking only becomes final once it has been confirmed by Plunged’s booking system and, where applicable, the required payment has been made or a valid credit has been used.
4.3. Bookings are always subject to availability. Holding credits or an Unlimited Membership does not guarantee the availability of a particular time slot.
4.4. The customer must provide accurate and up-to-date personal data and is responsible for the use of their account.
4.5. Accounts, memberships and credits are personal. Sharing accounts or allowing other persons to use personal credits or memberships is not permitted.
5.1. Current prices are stated on the website, in the app and/or during the purchase process.
5.2. All prices addressed to consumers are shown in euros and include the applicable VAT, unless expressly stated otherwise.
5.3. Payment is made via the payment methods offered by Plunged.
5.4. Single sessions, credits, credit packs, gift cards and other one-off purchases are in principle paid in full at the time of purchase.
5.5. For memberships with recurring payments, the customer authorises Plunged to collect the amount due periodically via the chosen payment method.
5.6. The customer is responsible for having a valid payment method and sufficient funds.
5.7. If a periodic payment fails, Plunged may temporarily suspend access to bookings and facilities and cancel future bookings until the outstanding amount has been paid.
5.8. Promotions, discount codes and special rates may have their own conditions and validity periods and cannot be combined unless expressly stated otherwise.
Credits and Credit Packs are strictly personal and non-transferable.
Unless a different period is expressly stated at the time of purchase, regular credits and Credit Packs are valid for twelve months from the date of purchase.
After the expiry date, unused credits expire automatically. Expired credits are not refunded, converted into cash or automatically extended, except where mandatory law provides otherwise or Plunged exceptionally decides otherwise.
A credit that is used in time for a booking and is subsequently cancelled in time in accordance with Article 9 will be made available again within its original period of validity.
The Plunged Welcome Pack currently consists of three credits for €45 and is intended exclusively for new customers.
The Welcome Pack:
Plunged may change the content and price of future Welcome Packs. Such a change does not affect a Welcome Pack that has already been purchased.
7.1. The Unlimited Membership gives the customer access to Plunged’s eligible regular sessions, always subject to availability and the fair use conditions of Article 8.
7.2. At the time of this version, the standard Unlimited Membership costs €90 per month, unless a different rate is expressly agreed during the purchase.
7.3. The Unlimited Membership is entered into for an indefinite period and is billed monthly. There is no minimum contract term, unless expressly stated otherwise for a specific deviating membership.
7.4. The first monthly period starts on the agreed start date. Thereafter, the membership is automatically billed each month until it is cancelled.
7.5. A customer can cancel the Unlimited Membership at any time via the function provided for this purpose in the app or on the website, or by sending an email to hello@plunged.be.
7.6. Upon cancellation, the membership remains active until the end of the monthly period already paid for. No further payments are made after that.
7.7. A monthly period that has already started is not refunded on a pro rata basis, unless mandatory applicable law provides otherwise.
7.8. The Unlimited Membership is strictly personal and non-transferable. Account sharing may result in the suspension or termination of the membership.
7.9. Plunged may adjust the price of the Unlimited Membership for future billing periods. A price change for an ongoing membership will be communicated to the customer in advance. If the customer does not wish to accept the new price, they may terminate their membership before the new price takes effect.
8.1. An Unlimited Membership is intended for normal personal use of Plunged.
8.2. With an Unlimited Membership, a maximum of two sessions per calendar day may be attended.
8.3. An Unlimited Member may hold a maximum of three future bookings in their account at the same time.
8.4. As soon as a booked session has taken place or has been cancelled in time, a new future booking can be made.
8.5. “Unlimited” does not mean that Plunged guarantees availability in a particular time slot.
8.6. Systematically blocking time slots, account sharing, booking without the intention of attending, repeated late cancellations or no-shows, or any other evident attempt to misuse the system is considered abuse.
8.7. In the event of abuse, Plunged may, depending on the seriousness and frequency, issue a warning, temporarily restrict booking options, cancel future bookings or terminate the membership. Except in the case of serious or repeated breaches, Plunged will first give the customer the opportunity to adjust their behaviour.
9.1. A cancellation period of 10 hours applies to regular sessions.
9.2. A booking can be cancelled free of charge via the website or app if the cancellation is made at least 10 hours before the scheduled start time.
9.3. In the event of a timely cancellation, a used credit is released again within its original period of validity.
9.4. A cancellation made less than 10 hours before the scheduled start of the session is a late cancellation.
9.5. If the booking was made with a credit, the credit used is forfeited in the event of a late cancellation.
9.6. For a separately paid session, there is no right to a refund in the event of a late cancellation.
9.7. For an Unlimited Membership, a fee of €5 is charged for a late cancellation.
9.8. If a participant does not show up and has not cancelled the booking in time, this counts as a no-show.
9.9. For customers with credits, the credit used is forfeited. For separately paid sessions, the amount paid is forfeited.
9.10. For Unlimited Members, a fee of €10 is charged for a no-show.
9.11. Repeated late cancellations or no-shows may result in a temporary restriction on the ability to book new sessions.
9.12. Plunged may, exceptionally and at its own discretion, apply goodwill in special circumstances. Such a commercial gesture does not create any right to the same treatment in other cases.
10.1. Participants are asked to arrive approximately 5 to 10 minutes before the start of their session.
10.2. Checking in with a Plunged staff member or via a check-in system provided by Plunged is mandatory.
10.3. The booked session starts at the indicated time. Late arrival does not entitle the participant to an extension of the session.
10.4. If a participant arrives so late that safe participation, the operation of Plunged or the comfort of other participants is disrupted as a result, access to the session may be refused.
10.5. In that case, the booking may be treated as a late cancellation or no-show.
11.1. The minimum age for using Plunged’s sauna and cold plunge facilities is 18 years.
11.2. Persons under the age of 18 are not admitted, unless Plunged expressly decides otherwise for a specific event.
11.4. Plunged may require this consent to be confirmed in writing or electronically and may, where reasonable, request proof of age or identity.
12.1. Every participant must comply with Plunged’s current House Rules.
12.2. These rules cover, among other things, swimwear, clean slippers or flip-flops, showering, use of towels, hygiene, privacy, lockers and behaviour towards other participants and staff.
12.3. During regular sessions, Plunged provides a towel as part of the service, unless stated otherwise for a specific product or event.
12.4. Participants must bring their own clean slippers or flip-flops.
12.5. A towel must always be used in the sauna so that the body does not come into direct contact with the wood.
12.6. Showering before entering the sauna or cold plunge is mandatory in accordance with the House Rules.
12.7. Instructions from staff regarding hygiene, safety and correct use of the facilities must be followed immediately.
12.8. Plunged may amend the House Rules where reasonably necessary for safety, hygiene or operational reasons. The current version is made available via the website, app and/or at the location.
13.1. Bringing your own food and drink into Plunged is not permitted, except water in a suitable, unbreakable reusable drinking bottle, insofar as it is used in accordance with the House Rules.
13.2. Glass bottles and other breakable containers are prohibited in the sauna and cold plunge area.
13.3. Using the sauna or cold plunge under the influence of alcohol, drugs or other substances that may affect safe participation is prohibited.
13.4. If a staff member reasonably suspects that a participant is under the influence or is behaving in a way that endangers their own safety or that of others, Plunged may refuse access or ask the participant to leave the facilities.
13.5. If access is refused for that reason, there is no right to a refund or to the restoration of the credit used.
13.6. Smoking and vaping are not permitted in Plunged’s indoor areas or in places where this is prohibited by law or by Plunged.
14.1. Due to exposure to heat, cold and temperature fluctuations, the use of saunas and cold plunges involves risks that are inherent to these activities.
14.2. Each participant is personally responsible for assessing whether they are physically able to participate safely.
14.3. Participants who are pregnant, have a medical condition, have recently been injured or undergone surgery, take medication that may affect their response to heat or cold, or have any other reason to doubt whether they can participate safely, are advised to seek medical advice before participating.
14.4. Particular caution is advised in cases including, but not limited to, cardiovascular conditions, blood pressure problems, epilepsy, respiratory problems, conditions in which cold or temperature fluctuations may cause symptoms, and other relevant medical conditions.
14.5. Plunged does not provide medical advice. Information from Plunged or its staff about sauna, cold, recovery or wellness does not replace professional medical advice.
14.6. A participant who feels dizzy, nauseous, light-headed, short of breath or otherwise unwell must stop immediately and inform a staff member.
14.7. Participants must enter the cold plunges calmly and in a controlled manner and follow all safety instructions.
14.8. Participants must not expose themselves or others to unnecessary risks and must not use equipment in a way for which it is not intended.
15.1. Every participant must treat other visitors, staff, the infrastructure and the facilities of Plunged with respect.
15.2. Intimidation, aggression, discrimination, threats, dangerous behaviour, wilful damage, repeated disturbance of other visitors or disregarding safety instructions will not be tolerated.
15.3. In such circumstances, Plunged may ask a participant to leave the premises immediately.
15.4. In the event of serious or repeated breaches, Plunged may temporarily suspend access or terminate the agreement or membership.
15.5. Immediate termination without a refund will only be applied where the seriousness of the breach reasonably justifies it, for example in cases of fraud, account sharing, aggressive behaviour, serious safety breaches or wilful damage.
15.6. The customer remains liable for damage they cause intentionally or through a fault attributable to them to the property of Plunged or third parties.
16.1. Plunged provides lockable lockers for use during the session.
16.2. Lockers may only be used during the visit and must be completely emptied afterwards.
16.3. Participants remain responsible for the careful safekeeping of their personal belongings.
16.4. Plunged is not liable for the loss, theft or damage of personal belongings where such damage is not the result of a fault attributable to Plunged.
16.5. Participants are advised not to bring valuables.
16.6. Lost property may be kept by Plunged for 30 days. After this period, Plunged may remove, donate or otherwise dispose of it.
17.1. Plunged Gift Cards are valid for twelve months from the date of purchase, unless a longer period of validity is expressly stated at the time of purchase.
17.2. A Gift Card can be used for eligible Plunged products or services as stated at the time of purchase.
17.3. Gift Cards are transferable unless expressly designated as personal.
17.4. Gift Cards cannot be exchanged for cash, in whole or in part.
17.5. After the period of validity has expired, the remaining balance is forfeited, unless mandatory law provides otherwise.
18.1. Plunged may cancel or modify a session where this is necessary due to technical problems, safety or hygiene reasons, unforeseen operational circumstances or other circumstances that make safe or proper performance impossible.
18.2. If Plunged cancels a session booked with credits, the credit used is restored or the customer may rebook free of charge.
18.3. If a separately paid session is cancelled by Plunged and no suitable alternative can be offered, the customer may choose between rebooking free of charge, an equivalent credit or a refund for the session concerned.
18.4. Minor changes to opening hours, scheduling, layout, the availability of individual facilities or the organisation of a session do not in themselves give rise to a right to compensation, provided the essence of the purchased service can still reasonably be delivered.
18.5. If a substantial closure over a longer period means that an Unlimited Member cannot reasonably use their membership, Plunged will offer an appropriate solution, for example an extension, temporary suspension or other reasonable compensation.
19.1. Unlimited Memberships in principle have no general freeze arrangement, as they can be cancelled monthly.
19.2. In special circumstances, such as long-term medical incapacity or pregnancy, Plunged may, upon request, grant a temporary pause, extension or other appropriate arrangement.
19.3. Plunged may request reasonable proof supporting the special circumstance.
19.4. Such an arrangement is assessed on a case-by-case basis and does not create a general right to a freeze.
20.1. When a consumer concludes an agreement online for which the law provides a right of withdrawal, they in principle have 14 calendar days from the conclusion of the agreement to withdraw from it without giving any reason.
20.2. For bookings of leisure services which, under the agreement, are to be provided on a specific date or within a specific period, Belgian law provides an exception to the statutory right of withdrawal.
20.3. A Plunged session booked online for a specific time can therefore not be cancelled solely on the basis of the general 14-day right of withdrawal. The cancellation conditions of Article 9 apply.
20.4. For Credit Packs, Welcome Packs, memberships, Gift Cards and other products purchased online to which no statutory exception applies, the consumer may exercise the applicable right of withdrawal in accordance with the law.
20.5. If the consumer requests that a service begin during the withdrawal period, Plunged may ask them to confirm this expressly.
20.6. If the consumer has expressly requested performance during the withdrawal period and subsequently withdraws within the statutory period after services have already been provided, Plunged may, in accordance with the applicable legislation, charge a proportionate amount for the part of the service already performed.
20.7. The right of withdrawal does not affect an individual session that has already been booked for a specific date and time and to which the statutory exception for leisure services applies.
20.8. Withdrawal can be communicated via hello@plunged.be by means of an unequivocal statement showing that the consumer wishes to withdraw from the agreement.
20.9. If the statutory conditions for withdrawal are met, Plunged will refund the amounts due within the statutory period using the same payment method, unless agreed otherwise.
21.1. Plunged undertakes to operate its facilities in a careful and safe manner and to take reasonable measures with regard to maintenance, hygiene and safety.
21.2. The participant remains responsible for complying with the House Rules and safety instructions and for the correct use of the facilities.
21.3. Plunged is not liable for damage that arises solely or mainly because a participant:
(a) does not follow safety instructions or House Rules;
(b) uses the facilities incorrectly or recklessly;
(c) knowingly participates while they know or should reasonably know that their state of health prevents safe participation; or
(d) participates under the influence of alcohol, drugs or other substances.
21.4. Where both Plunged and the participant have contributed to the damage, liability is assessed in accordance with the applicable statutory rules.
21.5. Nothing in these general terms and conditions is intended to exclude or limit Plunged’s liability where such exclusion or limitation is not permitted under mandatory Belgian law, including liability for death or personal injury caused by an act or omission of Plunged for which it is legally liable.
21.6. In performing its services, Plunged may rely on auxiliary persons, including but not limited to its directors, employees, staff, self-employed service providers, agents and subcontractors.
To the extent permitted by law, the customer and participant agree that they will not bring any extra-contractual liability claim against these auxiliary persons for damage related to the performance of an agreement with Plunged. The contractual liability regime and any defences and limitations to which Plunged is entitled under these general terms and conditions shall, to the extent permitted by law, also apply for the benefit of these auxiliary persons.
This provision is without prejudice to cases in which such an exclusion or limitation is not permitted by law, including in particular damage caused with the intention of causing damage and damage resulting from an infringement of physical or mental integrity.
22.1. Plunged is not liable for the non-performance or delayed performance of obligations where this is the result of an event beyond its reasonable control that makes performance temporarily or permanently impossible.
22.2. Depending on the circumstances, this may include, among other things: fire, flooding, serious utility or power outages, government measures, serious technical incidents of external origin and other comparable events.
22.3. Plunged will inform the customer as soon as reasonably possible when such a situation affects a booking or membership.
22.4. If, as a result, a specific paid session cannot take place, the principles of Article 18 apply.
23.1. Plunged may offer private sessions, corporate events, group bookings or other special formats.
23.2. Additional conditions, prices, deposits and cancellation periods may apply to these, which will be communicated before the booking.
23.3. The person or company making a group booking shall ensure that the participants receive the relevant House Rules and safety information.
23.4. Each individual participant remains bound to respect Plunged’s safety and conduct rules.
24.1. Plunged processes personal data in accordance with the applicable privacy legislation, including the General Data Protection Regulation (“GDPR”).
24.2. More information about which personal data are processed, for which purposes, on which legal basis and for how long is set out in Plunged’s separate Privacy Statement.
24.3. By making a booking for other participants, the customer confirms that they only provide those participants’ personal data to Plunged where they are entitled to do so.
25.1. Complaints about a purchase, booking or service can be sent to: hello@plunged.be
25.2. Please include sufficient information to allow the complaint to be investigated, including, where relevant, the customer’s name, the date of the session and the booking concerned.
25.3. Plunged will investigate complaints as quickly as reasonably possible and will endeavour to reach an appropriate solution.
25.4. If a consumer and Plunged are unable to resolve a consumer dispute between themselves, the consumer may, under the applicable conditions, contact the Consumer Ombudsman Service (Consumentenombudsdienst), Koning Albert II-laan 8 bus 1, 1000 Brussels, contact@consumentenombudsdienst.be.
26.1. Plunged may amend these general terms and conditions where necessary due to changes in legislation, changes to its offering, safety or operational reasons or other reasonable business reasons.
26.2. The version in force at the time of a one-off purchase or booking in principle remains applicable to that purchase or booking.
26.3. Material changes affecting an ongoing Unlimited Membership will be communicated to the customer in advance.
26.4. If a change substantially alters the essential rights or obligations of an ongoing Unlimited Membership to the detriment of the customer, the customer may terminate the membership before the change takes effect.
27.1. If any provision of these general terms and conditions proves to be wholly or partially invalid, void or unenforceable, this shall not affect the validity of the remaining provisions.
27.2. In that case, the provision concerned shall only be disapplied to the extent necessary and shall, where legally possible, be interpreted in accordance with the applicable legislation and its original purpose.
27.3. The fact that Plunged does not exercise a right at any given time does not constitute a waiver of that right.
28.1. These general terms and conditions and all agreements with Plunged are governed by Belgian law.
28.2. For consumers, the competent court is determined in accordance with the mandatory statutory rules on jurisdiction.
28.3. For disputes with customers acting in the course of their professional or business activities, the competent courts of the judicial district of East Flanders, Ghent division, shall have jurisdiction, unless otherwise agreed in writing.
